SimplyFeedback Acceptable Use Policy

This Acceptable Use Policy explains what is not allowed when using SimplyFeedback. It applies to all users of SimplyFeedback, including account owners, team members, invited users, survey creators, and anyone else who accesses or uses the Services.

SimplyFeedback is operated by EmberPeak Studio Ltd. This policy forms part of our Terms of Service. By using SimplyFeedback, you agree not to misuse the Services or help anyone else do so.

A simple rule

Use SimplyFeedback responsibly.

Do not use SimplyFeedback to harm people, invade their privacy, mislead respondents, collect information you are not allowed to collect, or make high-risk decisions about people without proper safeguards.

If you are unsure whether a use is allowed, contact us before using SimplyFeedback for that purpose.

Survey and respondent data

You are responsible for the surveys you create, the questions you ask, the people you send them to, and the information you collect through SimplyFeedback.

You must only collect, upload, submit, analyse, or otherwise process personal information through SimplyFeedback where you have the necessary rights, permissions, notices, consents, lawful bases, and authority to do so.

You must not mislead people about:

• who is running a survey;
• why information is being collected;
• how responses will be used;
• whether responses are anonymous or identifiable;
• whether responses will be shared with someone else;
• whether AI will be used to analyse the responses.

If you say a survey is anonymous, you must make sure that is true in practice. Do not collect names, email addresses, unique links, metadata, free-text identifiers, or other information that could identify respondents unless you clearly explain this to them.

Sensitive and restricted information

Unless we expressly agree otherwise in writing, you must not use SimplyFeedback to collect, upload, submit, store, or analyse sensitive or restricted information.

This includes:

• health information;
• racial or ethnic origin;
• political opinions;
• religious or philosophical beliefs;
• trade union membership;
• sex life, sexual orientation, gender identity, or transgender/nonbinary status;
• biometric or genetic data;
• precise geolocation;
• information about children;
• passport numbers, driving licence numbers, national insurance numbers, social security numbers, tax identifiers, or other government identifiers;
• payment card numbers, bank account access details, or financial account credentials;
• criminal offence data;
• immigration or citizenship status;
• passwords, authentication secrets, API keys, or private credentials;
• any other information that requires special protection under applicable law.

If you accidentally submit restricted information, you must delete it promptly where possible and notify us if you need assistance.

No unlawful, harmful, or abusive use

You must not use SimplyFeedback to create, distribute, host, analyse, or support content or activity that is unlawful, harmful, abusive, or violates the rights of others.

This includes using the Services to:

• break the law or encourage others to break the law;
• harass, threaten, intimidate, shame, bully, or target people;
• promote hate, violence, exploitation, or discrimination;
• collect information for stalking, doxxing, blackmail, surveillance, or harassment;
• impersonate a person, company, organisation, or public authority;
• misrepresent your identity, affiliation, purpose, or authority;
• run deceptive surveys, fake research, phishing forms, scams, or fraudulent campaigns;
• collect login credentials, payment details, security codes, or secrets;
• distribute malware, malicious links, or harmful code;
• interfere with, disrupt, or overload the Services;
• probe, scan, or test the vulnerability of our systems without permission;
• bypass rate limits, access controls, payment limits, or security measures;
• use the Services in a way that infringes privacy, intellectual property, confidentiality, publicity, or other rights.

No spam or unwanted communications

You must not use SimplyFeedback to send or support spam, unsolicited bulk messages, deceptive outreach, or unlawful marketing.

If you invite people to complete a survey, you are responsible for making sure you have the right to contact them. You must comply with applicable email, messaging, marketing, privacy, and anti-spam laws.

You must not use SimplyFeedback to:

• send surveys to purchased, scraped, or unlawfully obtained contact lists;
• contact people who have opted out;
• hide or misrepresent who sent a survey;
• use misleading subject lines, sender names, links, or branding;
• repeatedly contact people who have not agreed to participate;
• use surveys as a pretext for advertising, phishing, recruitment, profiling, or data harvesting.

AI-generated outputs

SimplyFeedback may use AI to help generate survey questions, analyse responses, summarise feedback, identify themes, classify responses, estimate sentiment, and produce insights.

AI-generated outputs are provided to assist you. They may be incomplete, inaccurate, biased, misleading, or unsuitable for your particular use case. You are responsible for reviewing outputs before relying on them.

You must not use AI-generated outputs from SimplyFeedback as the sole basis for decisions that have legal, financial, employment, educational, housing, healthcare, insurance, immigration, law enforcement, or similarly significant effects on a person.

You must not use SimplyFeedback to generate or support unlawful, discriminatory, deceptive, harmful, or abusive content.

High-risk uses

SimplyFeedback is not designed for high-risk decision-making.

Unless we expressly agree otherwise in writing, you must not use SimplyFeedback for:

• hiring, firing, promotion, disciplinary, or workplace eligibility decisions;
• healthcare diagnosis, treatment, triage, or medical advice;
• credit, lending, insurance, housing, benefits, or eligibility decisions;
• education admissions, grading, discipline, or student-record decisions;
• immigration, legal, law enforcement, or public authority decisions;
• psychological profiling, vulnerability detection, or manipulation;
• surveillance, monitoring, or tracking of individuals;
• any use where an error, bias, or misuse could reasonably cause significant harm to a person.

You may use SimplyFeedback to gather general feedback, but you remain responsible for making sure your use is lawful, fair, transparent, and appropriate.

Children

You must not use SimplyFeedback to knowingly collect personal information from children unless you have our prior written permission and you comply with all applicable child privacy, consent, safeguarding, and age-appropriate design requirements.

For the purposes of this policy, “children” means individuals under the age at which they can lawfully consent to the relevant processing in their country or region.

Security and access

You are responsible for keeping your account secure.

You must not:

• share account credentials with unauthorised people;
• allow unauthorised access to your workspace;
• attempt to access another user’s account, workspace, survey, responses, or reports;
• use another person’s account without permission;
• remove, disable, or bypass security features;
• upload malicious files, scripts, links, or code;
• use the Services to test or attack systems without permission.

If you discover a security issue, please report it to us promptly and do not exploit it or disclose it publicly until we have had a reasonable opportunity to investigate.

Respect intellectual property and confidentiality

You must not upload, submit, generate, or share content that infringes someone else’s intellectual property, confidentiality, trade secrets, contractual rights, or privacy rights.

You must not use SimplyFeedback to collect or analyse confidential information unless you have the right to do so.

You are responsible for the content you submit to SimplyFeedback and for making sure you have the rights needed to use it with the Services.

Platform integrity

You must not misuse SimplyFeedback or interfere with the operation of the Services.

You must not:

• reverse engineer, scrape, copy, or extract data from the Services except as permitted by law or our Terms;
• use bots, scripts, or automated tools in a way that harms the Services or other users;
• create multiple accounts to avoid limits, restrictions, suspension, or billing;
• resell, sublicense, or provide access to the Services without permission;
• use the Services to build a competing product using our non-public features, design, or outputs;
• abuse free trials, promotions, referrals, credits, or usage limits;
• remove or obscure ownership, attribution, security, or legal notices.

Enforcement

We may investigate suspected violations of this policy. We will try to act reasonably and proportionately, taking into account the seriousness of the issue, the evidence available, the risk of harm, and whether the issue can be corrected.

Where appropriate, we may:

• contact you for more information;
• require you to remove content or change how you use the Services;
• disable a survey, link, report, integration, feature, or workspace / organisation;
• restrict access to some or all of the Services;
• suspend or terminate an account;
• preserve information where necessary for legal, security, or abuse-prevention purposes;
• notify affected parties where appropriate or required;
• report unlawful or harmful activity to relevant authorities where required or appropriate.

Serious violations may result in immediate suspension or termination without prior notice.

Accessing customer content during investigations

We respect the privacy of customer content and survey responses.

When investigating abuse, security, or policy violations, we will try to rely on account information, metadata, logs, user reports, and other available evidence before accessing customer content. However, we may access, review, preserve, or disclose customer content where we reasonably believe it is necessary to investigate misuse, protect people, secure the Services, comply with law, enforce our agreements, or prevent harm.

Please include enough information for us to understand and investigate the issue, such as the survey link, account or workspace details, screenshots, dates, and a description of the concern.

Changes to this policy

We may update this Acceptable Use Policy from time to time. The updated version will be indicated by a revised “Last updated” date. Your continued use of SimplyFeedback after an update means you accept the updated policy.
